2 June 2005 - the County Council decided to make an Order for a footpath from the Inn to Footpath 19 on the grounds that this was the route accepted in 1954 and the statement for Footpath 19 states that it meets the footpath. The County Council made the decision to make an Order on 5 January 2007 following the direction.

The applicant appealed to the Government Office. The County Council was directed to make an Order for a footpath along the whole of the route on 3 August 2006. A number of objections to the Order were submitted. The Order was submitted to the Secretary of State on 9 June 2008 for determination. A public inquiry was held at Woolsthorpe village hall on 16 December 2008.

The Secretary of State decided on 23 January 2009 not to confirm the Order. It was considered that the evidence adduced by the Applicant was insufficient, on the balance of probabilities, to demonstrate that such a public right subsists.
