That an order be made to add a public footpath to the Definitive Map and Statement running between Stixwould Road and the south-eastern corner of the playing field/cricket ground, but not make an order to add the continuation of the path across the playing field, through to King Edward Crescent. There is deemed to be sufficient evidence to reasonably allege that footpath rights subsist along the first section but insufficient evidence for the continuation across the playing field. Use of the way across the playing field/cricket ground is deemed to be ‘by right’ not ‘as of right’. As the proposed Order does not add the whole route applied for, the Applicant has a right to appeal the council’s decision to the Secretary of State.
