14 May 1993 - decision to make an Order to add the claimed byway open to all traffic as there was evidence to show it was deemed a public highway. The Order was made 27 August 1993.

Objections to the Order have been received. The Order has been submitted to the Secretary of State for determination. Determination of the Order will be done through the written representation procedure. The County Council no longer supports the Order on the ground that there was insufficient evidence to support public rights on the Order route.

The Secretary of State decided on 18 March 2014 not to confirm the Order. It was considered that "the evidence as a whole is not sufficient to tip the balance in favour of a finding that the claimed route has been dedicated as a vehicular highway or indeed a lesser class of highway". The inspector concluded on the balance of probabilities that a right of way has not been found to subsist.
