The Council determined to not make a modification order on the grounds that there was insufficient evidence to reasonably allege the existence of the BOAT rights over the public rights of way or the “missing link” between Stubton Public Footpath 2 and Restricted Byway 7 that are subject to the claim. Although Westborough and Dry Doddington Public Bridleway 12 is shown marked in historical Ordnance Survey maps as a ‘Coach Road’, it is recorded as a ‘private road’ in the 1771 Inclosure Award and a ‘private carriage road’ in the railway plan of 1845. The documentary evidence does existence of higher public rights over Stubton Public Footpaths 2 and 3 and Restricted Byway 7.
