On 25 January 2024, the County Council determined to make a definitive map modification order (DMMO) on the grounds that the documentary evidence and in particular the 1951 Tealby Parish Path Survey, is sufficient to reasonably allege that a public footpath exists.
Following the decision, the owners of Thorpe Mill offered to dedicate the route in question as a public footpath. A Public Path Creation Agreement was made under section 25 of the Highways Act 1980 formally dedicating the route as a public footpath, and a Legal Event Modification Order was made on 23 October 2024 in consequence of the Creation Agreement formally recording the route as a public footpath in the Definitive Map and Statement, the legal record of public rights of way. The route is known as Tealby Public Footpath 1217, and it together with Tealby Public Footpath 132 now provides a continuous route between Thorpe Lane and Sandy Lane. On 16 December 2024, the County Council decided close the case without making the DMMO on the grounds that the route was formally dedicated and recorded as a public footpath by the Public Path Creation Agreement and Legal Event Modification Order, so such an order was no longer needed to recognise the existence of public footpath rights along the route.
