The unconsented works behind Church Street in Nettleham - Find a freedom of information request

Further to my previous request (your ref 9899213)

Please provide the following further information concerning the unconsented works behind Church Street in Nettleham:

1. Copies of your correspondence to the Witham Third District Internal Drainage Board about their investigation;

2. A copy of the relevant Memorandum of Understanding between LCC and the IDB; [3] what LCC paid for the investigation;

3. What decision has now been made and by whom on whether to pursue enforcement action;

4. What information on previous flooding in Nettleham was used by LCC when evaluating the flood risk posed by the works (the IDB told me they had none).

Decision

I can confirm that the information requested is held by Lincolnshire County Council. I have detailed below the information that is being released to you.

1. As requested, please find enclosed copies of correspondence held between Lincolnshire County Council and Witham Third District Internal Drainage Board with respect to 5A Church Street, Nettleham

2. A copy of the Memorandum of Understanding between Lincolnshire County Council and Witham Third District Internal Drainage Board is enclosed. Invoices for recharge of works undertaken under the Memorandum of Understanding are paid on an annual basis and as such this information is not currently held by Lincolnshire County Council.

3. Having regard to guidance received from Witham Third District Internal Drainage Board no enforcement action is proposed with respect to the works concerned.

4. The decision on whether to progress enforcement action was based on the expert guidance from Witham Third District Internal Drainage Board and previous correspondence with residents and the parish council regarding Nettleham Beck.
