Placements in Independent Special Schools for pupils with SEND - Find a freedom of information request

This FOI request relates to Placements in Independent Special Schools for pupils with SEND, social emotional and mental health needs (SEMH) and autism (ASC). My request refers to pupils with EHCP's that are given council-funded placements in independent special schools approved under section 41 of the CAFAct 2014. My request refers to independent special schools that operate as day schools, residential schools, and children homes for pupils under the age of 25. My request is referring to all independent special schools that LCC fund placements for and is not restricted to schools in Lincolnshire.

1. For between 12.6.21 to the date this request is processed, I would like to find out the number of pupils that have been given council-funded placements in independent special schools, for each of the individual placements please provide the following:

a. The name of the school where the pupil is placed and

b. How many pupils have been placed at each of the settings

c. The duration of the placement for each pupil

I can confirm that the information requested is held by Lincolnshire County Council. I have detailed below the information that is being released to you.

Low figures are considered exempt under Section 40(2) of the Freedom of Information Act 2000 (FOIA) where disclosure would allow the possibility of a living individual being identified.

Lincolnshire County Council believes that providing this data could potentially lead to the identification of those children and that disclosure of and the potential risk to the rights of others that could result, would not provide any greater understanding of the subject matter.

We have therefore provided the response of ‘<5’ to provide insight without contravening Schedule 2 Part 3, Section 16 of the Data Protection Act 2018 relating to the protection of the rights of others.

We rely upon Section 40(2) FOIA to withhold this information in this regard.

c. Due to the volume of records and the amount of time it would take to go through each one to locate the duration for each pupil, this information is exempt under section 12 (1) of the FOI Act 2000.

Section 12(1) of the Freedom of Information 2000 does not oblige a public authority to comply with a request for information if the authority estimates that the cost of complying with the request would exceed the appropriate limit. The appropriate limit is currently £450 or 18 hours at a cost of £25 per hour. The exemption under section 12 is not subject to the public interest test
