Resurfacing works - Find a freedom of information request

I received the response to FOI 6972629 one year ago, 15th July 2023. The response states that the council recognised to works completed were not up to standard, the contractor had been notified and remedial works were to be completed by the end of September 2023. To date no remedial work has been completed. Therefore I would like the following questions answered.

1. How is value for money demonstrated, with regard to this situation? The Council have identified the works were not up to standard, informed the contractor, who was paid in full for the sub-standard work. Remedial work was due to be completed by the end of September 2023 but has not happened.

2. Is further work planned for this location? If so will the contractor be the same as previously and paid in full for these works?

3. Is there an expected lifespan of the resurfacing works?

4. How many more instances around Lincolnshire are there where the contractor who completed the work on Wells Drive has completed the work to a substandard quality?

5. Has the contractor been required to pay compensation to the Council in any form for substandard work? If so, how much as a percentage of the contract?

6. Remedial work was due to be completed by the end of September 2023 but has not happened. Was the provider required to complete this work and did not complete the task? Why was this remedial work not completed? Have the council been in any contact with the contractor about Wells Drive remedial work since June 15th 2023?

Decision

I can confirm that the information requested is held by Lincolnshire County Council. I have detailed below the information that is being released to you.

1. Lincolnshire County Council term maintenance contract is a cost reimbursable contract where the contractor is paid for all works completed. Any remedial identified and completed by the contractor are completed at their cost. Remedial works were requested and completed by the contractor at this location to no further cost to Lincolnshire County Council.

2. We have a 12-month maintenance for all works, and a further inspection will be carried out at the location to identify any additional works that may be required. Remedial works identified will be carried out by the same contractor and at no cost to Lincolnshire County Council.

3. We would anticipate these highways maintenance technique to provide serviceable life between 8-10 years

4. We have approximately five instances requiring remedial action.

5. The contractor does not have to pay compensation to Lincolnshire County Council.

6. The contractor has informed Lincolnshire County Council that they have completed the remedial works that were requested.
