1. nature of enforcement action required in you emails to myself 02/2023 04/07/2023 and 12/07/2023 from highways.

 

The verges have a set of Lincolnshire County Council (LCC) granite marks on them so clearly LCC are responsible.

 

Not cut for circa 20+ years

Reason given in emails " enforcement action “required”.

Advised it may take some time reason read please.

 

Put simply in the emails sent to me by LCC highways see previous email for dates you state that to enable you to cut the verges on the A17(T) maintained at the public expense enforcement action is required and will be a long process.

 

As I have heard nothing since 12/07/2023, I need to know just against who the enforcement action is needed.

 

So the FOI is for you to specify what and against who the enforcement action is being taken.

 

LCC has marker posts which indicate the verges are LCC property/responsibility.

 

The only enforcement action that I want to see is for you to get on with the long, 20 years, overdue verge cutting.

 

For clarity its the A17(T) maintained at the public expense road that is off the B6403 at NG34 8EY. That should be having the verges.

Decision

1. Lincolnshire County Council (LCC) can confirm that the hedge is private and was enforced and after inspection in September, had been cut back.

 

The emails you received on 02/07/2023, 04/07/2023 and 12/07/2023 were email updates that are sent out from the enquiry that you had submitted. These are sent out when the enquiry moves through different stages and status’s.

 

On the 02/07/2023 it was reassigned from the cyclic team to the local highways team and so you would have received notification of this. On the 4/7/23 the enquiry was moved to investigation ongoing status with notes to say that the liability was being checked with legal, and so you would have received an update then, and finally, on the 12/7/23 the enquiry was closed down at status 0175 Enforcement and you would have received the automatic email update for this.

 

As can be seen from the attached liability plan, part of the verge is highway maintainable and so LCC will carry out checks in the area to ensure grass cutting has been carried out to LCC standards and arrange for these works to be undertaken if necessary.
