Secretary of State determined not to confirm the Modification Order on 25 January 2013 on the grounds that fundamental procedural errors were fatal to the validity of the Order. In August 2012 the County Council determined not to make a further Order on the grounds that the evidence was insufficient to show that public rights were reasonably alleged to exist over the alleged footpath. No appeal was lodged against the County Council's determination.
