1. How many Property and Financial Affairs deputyships are currently managed a) by Lincolnshire County Council (LCC) themselves, and b) how many are managed by a third party on behalf of LCC?

2. How many Property and Financial Affairs deputyships are currently managed by c) relatives of LCC Clients in Care, and d) how many are managed by third parties pn behalf of LCC Clients in Care

3. What measures are in place to ensure that Care Homes in the Lincolnshire area who look after LCC Clients in Care are managing clients finances on the premises in accordance with the relevant legislation?

4. What sanctions are available to LCC when a breach of these measures are discovered?

5. How many instances have there been where there has been a breach of these measures?

6. What is the average monthly allowance provided to each adult client in care from the clients' own funds, where LCC manages the Deputyship, and what are the highest and lowest monthly amounts paid?

7. What mechanisms are in place for the client or the care home to request additional Funds and how quickly are the funds made available?

8. How many of LCC Clients in Adult Social care homes with limited or no capacity, a) have their own Bank Card (allowing them to buy on-line or withdraw cash from an ATM) and b) their own Prepaid card?
 

Decision

I can confirm that the information requested is held by Lincolnshire County Council. I have detailed below the information that is being released to you.

1.a) 72 managed by LCC

b) 0 deputyships managed by a third party on behalf of LCC

2. We do not have this information split in this way without significant manual Intervention

3. The Commercial Team may review resident finances as part of their annual contract management visit.

Contract Officers will review procedures and ensure that income/outgoings are appropriately recorded with receipts/2 signatures etc.

The Contract Officer will also ensure that appropriate policies and procedures are in place.

4. Where there is any breach of contract there are a number of sanctions available

• Improvement Plan

• Default Notice

• Suspension of Placements

• Termination of Contract

5. LCC are not aware of any instances of a breach of measures where Property and Financial Affairs Deputyships are managed by the care home.

6. Average is - £130.00 Lowest is - £113.00 Highest is - £200.00

7. All Deputyships that are held by Lincolnshire County Council are administered by the Court of Protection Team, if needed urgently there is a process in place to bank transfer funds or access emergency cash through the sundry accounts process the same working day.
