Atterby Lane, Snitterby definitive Rights of Way map - Find a freedom of information request

According to the online catalogue of Lincolnshire Archives, this document was accessioned by Lincolnshire Archives with a deposit of other Lindsey County Council documents (ref. Acc. 2005:080:00). However, the Collections Development Officer at Lincolnshire Archives has informed me that this document is no longer in their custody, as it was transferred to Lincolnshire County Council Highways on 17 August 2005.

 

The document is a definitive Rights of Way map covering the area of Caistor Rural District dated 31 May 1954.

 

The information, or a copy of the relevant part of the document, I am seeking is whatever information is given on the course of Atterby Lane and the adjacent land

 

1. Are there any features such as rights of way, footpaths, bridleways?

 

2. Is the road marked as a county maintained road or a private road?

 

3. Are telegraph poles shown? Or, is there no specific information recorded other than the course of the road and any properties on the road?

 

4. Is this a printed Ordnance Survey map (or other publication) with manuscript annotations etc.?

Decision

The Definitive Map and Statement for the areas of the former Caistor Rural District and Market Rasen Urban Districts is in the custody of the County Council’s Public Rights of Way and Access Section.  No reviews of the Definitive Map and Statement have been undertaken, which means that it (together with the associated modifying orders) remains the legal record of public rights of way for the area.  Please find below a copy extract of the Definitive Map.

Public footpaths are shown by a solid purple line, public bridleways are shown as a solid green line, and restricted byways (formerly roads used as public paths) as shown as broken green lines.

1. Atterby Lane is not recorded in the Definitive Map as a public right of way, i.e., a public footpath, public bridleway, restricted byway, or byway open to all traffic.  No definitive map modification orders have been made or confirmed in respect of Atterby Lane.

2. The Definitive Map just records public rights of way, i.e., public footpaths, public bridleways, restricted byways, and byways open to all traffic.  As pointed out in the answer to question 1, Atterby Lane is not recorded as a public right of way.  However, it is recorded as a publicly maintainable highways in the List of Streets maintained under section 36 of the Highways Act 1980.  The List of Streets can be viewed at https://www.findmystreet.co.uk/

3. Telegraph poles are not shown in the Ordnance Survey map on which the Definitive Map was drawn.

4. As part of the statutory process used to drawn up the Definitive Map and Statement under the National Parks and Access to the Countryside Act 1949, surveys were undertaken to ascertain the existence of public rights of way for inclusion in the Definitive Map. Ordnance Survey maps were acquired on which the public rights of way were then drawn, and they were then approved as the Definitive Map for the areas of the former Caistor Rural District and Market Rasen Urban Districts by Lindsey County Council (one of Lincolnshire County Council’s predecessor authorities) on 4 January 1971.  The only “manuscript” accompanying the Definitive Map is the Definitive Statement, and it does not list Atterby Lane as a public right of way (i.e., public footpath, public bridleway, restricted byway, or byway open to all traffic).
