Road surface repair. Lower High Street, Tentercroft Street, Lincoln - Find a freedom of information request

Under the freedom of information act I would like to receive information relating to a repair made to a road surface in the early part of 2023. The site is on the lower high street in Lincoln, in the pedestrian area near Tentercroft street. I am aware the works were carried out by ANGLIAN WATER, but as the agency responsible for roads I presume you will have a service level agreement with agencies that carry out this sort of work.

 

Since the repair several months ago, the area has remained with a "temporary" repair of black asphalt, with original bricks not being replaced.

 

I would like to know:

1) What service level agreement do you have in place with Anglian Water or other agencies relating to the repair of surfaces following works. I would also like to see any documents relating to the governance of this SLA.

 

2) What is the timescale for the bricks being replaced and the area being returned to its original condition?

 

3) Were the bricks that were removed damaged? If so how did that occur?

 

4) What happened to the original blocks when they were removed?

 

5) I would also like to see copies of all emails and correspondence that relate to these works between July 2022 and the date this request is processed (30/05/2023).

Decision

1. Statutory utility companies, such as Anglian Water, have a legal right to work in the highway under Section 48 of the New Roads and Street Works Act 1991 (NRSWA). In doing so, they are required to comply with Section 72 of NRSWA with regards to effective reinstatement, this includes reinstatement of specialist material. Temporary/interim reinstatements are permitted as part of the legislation and must be completed as permanent within six months of the initial work. This is national legislation, therefore, no service level agreements are required.

2. The replacement material is currently on order from a specialist quarry. At this time Lincolnshire County Council (LCC) have not been provided with a timeframe for delivery, however, Anglian Water are committed to completing this remedial and returning the area to its original state as soon as possible. The expiry of their interim reinstatement is the end of September 2023.

3. The blocks are set on and jointed with a hard concrete product to allow for trafficking. As this is the case, they chip and crack easily when excavated and it proves extremely difficult to excavate effectively and keep them in a suitable condition for re-use

4. They were disposed of by Anglian Water.

5. Copies attached along with the permit.
