- Outcome and reasons for the decision
-
Decision to make legal order for public footpath along Kiln Lane between High Holme Road and Northgate. The user evidence considered shows 12 instances of use as a public footpath over the period 1987-2007. The most significant documentary evidence considered is 1910 Finance Act documents which show most of the claimed public footpath as uncoloured and excluded from surrounding land parcels, which is a strong suggestion that it was considered to be public highway. These documents also show deductions from the tax for 'Public Rights of Way or User' in relation to two land parcels crossed by the claimed public footpath.
