Incident occurred on 26/11/21 on Little Gate Lane, Branston, asset C113/60.2.



If it is your view the road condition was not responsible for the damage and/or the road condition was at an acceptable level, I would like some further information in support of a small claims court application.

1.You informed me the roads were inspected just prior to the incident. Can you share the report with me of the particular stretch of road that the incident occurred.

2.What are the acceptable levels of road deterioration of this particular road surface and how is it measured.

3.There has been a recent repair to spot that the incident occurred and i have took pictures and documented that showing your road paint markings laid down to show areas that received a repair. These repair works have been carried out since I notified you of the incident.

4.What was the driver for these road repairs and not to repair other pot holes on the same stretch of road?

5. In your reply you have mentioned that the defect was not present or was of a size that was not a danger. Please explain what you think my clear images and measurements are showing? And/or what is the level that would present a danger? I would like to remind you, you have attempted to repair some parts of the area in question.

Please find link above for Lincolnshire County Councils Highways Infrastructure Asset Management Plan, this plan sets out our policy with regard to setting hierarchy of assets and from that the surveys, inspections, risk assessment, defect intervention levels and response times for the highway network in Lincolnshire.

While the entire Plan for Volume 0 and 1 are relevant I would draw attention to: Volume 0 Strategy and Hierarchy, Risk Based Approach. Volume 1 Highways and Appendix B of the Plan.

As such, this information is exempt from disclosure in accordance with the exemption set out at Section 21 of the Freedom of Information Act 2000 which provides that a public authority need not comply with a request for disclosure under the Act where that information is reasonably accessible by other means.

4. Highways Officers will apply the intervention criteria and risk assessment set out in Appendix B of the Highways Infrastructure Asset Management Plan as linked in 2.

Defects may have different response times based on their severity or their location in the carriageway, footway, or verge. Edge damage will be treated differently to distinct defects in the carriageway, particularly if they are in the wheel track of motorists or cyclists or there are other risk factors nearby. The contractor may sometimes repair defects at different times though would aim to complete them within the time frame set by LCC Officers as the client.
