Request

1. How much has it cost the council in compensation from applicants who have appealed a planning application due to refusal and has been subsequently approved?

Please can you provide figures from 2015 - 2021.

2. How many times has a planning committee refused, deferred or approved an application against the advice of planning officers?

Please can you provide applications or figures from 2015 - 2021.

3. How many refused planning applications have been forwarded to the relevant secretary of state from 2015 - 2021.

Decision

1. During the period requested Lincolnshire County Council haven’t paid any compensation/costs for appeals allowed by the Inspectorate following an earlier refusal by the Council. No claims for cost were made or awarded

 

2. The following applications have either been deferred or the Officers recommendation ‘overturned’ by Committee during the period requested. Details of these applications can be found on our website by searching using the ‘PL’ number on the following site - https://lincolnshire.planning-register.co.uk/

PL/0025/14 - Mansgate Hill, Nettleton - For importation, storage, screening, merchanting and distribution of primary aggregates, including sands, gravels and chippings, and, the importation, storage, processing, recycling, merchanting and distribution of secondary aggregates, soils and other materials, including bricks, concrete, incinerator ash/slag, road planings, stone and tiles, and, the retention and use in connection therewith of existing offices, workshops, bagging shed/storage building, garage, ticket hut, weighbridge, wheel wash, mineral storage bays, stockpiles and processing areas, lorry and car park areas and site access roads – Deferred by Committee for a site visit and then approved against Officers recommendation.

PL/0068/15 - Blue Sky Plastics Ltd, South Fen Road, Bourne, Lincolnshire, PE10 0DN - To vary condition 6 of planning permission S12/0601/14 (to allow the stockpiles to be up to a maximum of 6 metres in height) – Recommended for approval by Officers but refused by Committee.

PL/0045/16 – Dunston Quarry - To use land for the recycling of construction, demolition and excavation wastes – Recommended for refusal by Officers but approved by Committee

PL/0121/19 - Land off A1084, Kettleby, Brigg, DN20 9HH - To retain a tank for the storage of liquid organic waste – Originally recommended for approval by Officers but deferred for site visit and then refused in line with Officers revised recommendation.

PL.0126/20 – Reed Point, Spalding Sutterton - To remove condition 6 of Planning Permission B/16/0217 - to allow outside storage when the site is not in operation = Recommended for approval by Officer but refused by Committee. Appeal lodged/pending but not yet commenced. PL/0037/21 - Land off High Street, Biscathorpe - For a side-track drilling operation, associated testing and long-term oil production – Recommended for approval – Resolved to be refused by Committee. Going to Committee on 6 December to confirm reasons for refusal.

 

3. 5 as follows:

PL/218/14 – Highfield Quarry - Application for the restoration of the southern section of the quarry to an agricultural afteruse using quarry fines and soils screened from existing on-site materials – Appeal dismissed (i.e., Council’s decision to refuse upheld)

PL/0082/15 - Denton Quarry - For the extraction of limestone and importation of sustainable inert fill to achieve a beneficial restoration of the site – Appeal dismissed (i.e. Council’s decision to refuse upheld)

PL/0125/16 - Veolia, Lincoln to demolish an existing building, construct a new building and operate a waste transfer station, including the production of refuse derived fuel, with associated development including a new weighbridge, relocation of existing wash bay, diesel tank and re-alignment of existing fence line - Appeal submitted but subsequently withdrawn

PL/108/19 - Dunston Quarry - Extension of the existing quarry into 4ha of agricultural land – Appeal allowed (i.e., Council decision to refuse overturned)
