13 October 2004 the County Council decided to make an Order for a footpath along the claimed route on the grounds that there is evidence of long use by the public.

Objections to the Order were received and the Order was submitted to the Secretary of State for determination. A public inquiry was held at Horncastle College on 18 October 2011. An Inspector made a decision on 7 December 2011 to confirm the Order with a modification to increase the width to 3 metres. The objection period to this modification runs from 29 February to 11 April 2012.
