I can confirm that the information requested is held by Lincolnshire County Council (LCC). I have detailed below the information that is being released to you.
1. The Ladder is underpinned by statutory exclusions guidance in that there is a requirement for Head teachers to ensure that permanent exclusion is the 'last resort.' The Ladder sets out what resource is available to Lincolnshire schools – for example, the Pastoral Support Plan (PSP); the Behaviour Outreach Support Service (BOSS); the option of an intervention placement within alternative provision. Head teachers are encouraged to utilise these resources so that governors can be reassured, before ratifying a permanent exclusion for persistent disruptive behaviour (the main cause) that it is truly a last resort in the sense that resources, free to schools, have been drawn upon within a solutions-focused plan to identify and address the issues and change the trajectory. The Ladder is also informed by the SEND Code of Practice in that it promotes a graduated approach – cycles of assess-plan-do-review – rather than one-size-fits all application of a behavior policy. In this regard, it also translates the Equality Act 2010 into guidance for schools, in relation to the requirement to make reasonable adjustments when disabilities such as ADHD or ASD make fixed standards of behavior difficult for some learners to consistently reach, for example because of the poor executive functioning.
