To make a Modification Order to record a restricted byway over that part of Heapham Lane running from Elm Tree Farm to Kirton Gate Lane and over Kirton Gate Lane. The documentary evidence demonstrates the existence of an awarded public road along these lanes, albeit that the public vehicular rights have been extinguished by section 66 of the Natural Environment and Rural Communities Act 2006 thus leaving a public right of way for non-mechanically propelled vehicles (i.e. a restricted byway). There was insufficient evidence to demonstrate the existence of a public right of way over Green Lane and Bratt Field South Road, so these will not be included in the Modification Order.
