Several objections were lodged against the making of the Modification Order, some of which remained unwithdrawn. The Order, objections, evidence and the requisite documents were submitted to the Secretary of State for Environment, Food and Rural Affairs in February 2023 for a decision based on the evidence on whether the Order should be confirmed or not. In a decision of 6 March 2025, the Secretary of State considered the evidence shows that there had been sufficient qualifying public use of the routes over the 20-year term mid- 1988 to mid-2018 to give rise to the statutory dedication of public footpath rights. As a result of the confirmation of the Order, the route running along Roman Bank and over the sandhills between Public Footpath 37 and the seafront (i.e., the promenade) and the route running through the passageway between Roman Bank and St Leonards Drive are now recorded as public footpaths in the Definitive Map and Statement. They are called “Chapel St Leonards Public Footpath 1182” and “Chapel St Leonards Public Footpath 1183”, respectively.
