Two Modification Orders were found to be erroneous:
- seeking the addition of a BOAT between Trent Port and the River Trent
- seeking the addition of a public footpath running north from Trent Port long the east bank of the River Trent
Further Modification Orders were made in respect of these routes and they were confirmed by the Secretary of State for the Environment on 20 May 1996. However, this left the two original Orders undetermined. These were submitted to the Secretary of State for Environment, Food and Rural Affairs on 28 January 2020 for a determination.
In a decision of 25 September 2020 the Secretary of State determined not to confirm the Orders on the grounds that the BOAT and public footpath they seek to add are already recorded as such in the legal record of public rights of way, the Definitive Map and Statement, as a result of the Orders that were confirmed on 20 May 1996.
