-
An Order to be made to delete Colsterworth FP14 and Stainby FP1 to Skillington Road. Also to realign Stainby FP1 (from Skillington Road to parish boundary with Buckminster) to lie in the parish of Colsterworth apart from a small section near Stanton Plantation. The county council believes that the evidence is deemed to be sufficient to show that public footpath rights do not exist from Water Lane, Woolsthorpe to Skillington Road and that the remaining public footpath rights on Stainby FP1were incorrectly recorded and should be shown to reflect the Colsterworth with Woolsthorpe and Twyford Enclosure Award 1808.
- Details of appeal to the Secretary of State
-
Objections to the Order were received and the Order has been submitted to the Secretary of State for determination. The inspector decided on 7th July 2016 to propose the confirmation of the deletion from Water Lane to Skillington Road but made modifications to the order to not realign the section running from Skillington Road to Buckminster. A period from 12th August to 9th September 2016 will be advertised allowing any objections or representations to be made only to those proposed modifications.
- Date modification order made
- 16 April 2015
- Confirmation,non confirmation (with,without mods)
-
The Secretary of State decided on 22nd February 2017 to confirm the Order as made. The inspector reconsidered the evidence following a further submission and corrected his previous decision accepting that Gunby & Stainby Footpath 1 (part) was incorrectly put on the definitive map and that the path should be put on the line as shown on the Colsterworth Inclosure Award 1808.
