Not to make the Modification Order applied for. Decision based on there being insufficient evidence that the footpath and bridleway have a higher status and that motor-propelled vehicle rights shown to exist over the restricted byway have been extinguished by Section 67 of the Natural Environment and Rural Communities Act 2006. To make a Modification Order to add to the Definitive Statement for Ancaster Restricted Byway No.13 an awarded width of 60ft. The width to apply to the section of Restricted Byway running from Point B on the application map, westwards to Carlton Scroop parish boundary. The limitation of a gate to be recorded, where Ancaster Restricted Byway No.13 meets Carlton Scroop parish boundary.
