Decision made to make an Order to add to the Definitive Map and Statement a public footpath running between Plough Hill and Butter Market in Caistor. The user-evidence considered shows substantial and frequent use of the footpath throughout the relevant 20 year period between June 1989 and June 2009, with 20 instances of actual enjoyment of the whole footpath on foot for the full 20 year period.
Documentary evidence shows that the passageway through which the footpath runs has existence since at least 1796. The 1910 Finance Act documents show the footpath as uncoloured and excluded from the surrounding parcels of land, which is a strong suggestion that it was considered to be a public highway. There is evidence which may imply that the footpath was maintained by the highways authority on various occasions. The County Council believes that public footpath rights are reasonably alleged to exist over the route with statutory and common law dedication having occurred.
