To make a Modification Order to delete Footpath 9 from the Definitive Map on the grounds that it is not a public right of way. The evidence shows that the path was put forward for inclusion in the process used to draw up the Definitive Map in the 1950s. However, an objection was lodged against its inclusion. A public hearing held to determine the objection found that there was insufficient evidence to demonstrate that it was a public right of way. The Surveying Authority at the time, Lindsey County Council, upheld the outcome of the public hearing and resolved to delete the path from the draft map, but the path was erroneously included in the provisional map and then the Definitive Map. No evidence has been discovered which supports that the route is subject to a public right of way.
